Please read these terms and conditions before using the website and services  and governed according to Kuwait law (from here on as referred to as “we”, “our”, “us”). The products and services that feature on (the “Web Site") are made available to you in accordance with these terms and conditions and any other rules posted on the Web Site from time to time (collectively, the “Terms and Conditions”).

By using the Website and any related service in any way, including (without limitation) visiting or browsing the Website, as well as selling, buying, contributing content, information and other materials or services on the Website, you (or the "user") agree to be bound by the Terms and Conditions, which constitute an agreement between you and us, and you warrant that you have the capacity and ability to agree to the Terms and Conditions and to carry out your obligations as set out in the Terms and Conditions. If you do not accept and agree to be bound by the Terms and Conditions, you must not register yourself on the Web Site and must not use the Web Site or any of our services. You agree that the electronic format of the Terms and Conditions does not in any way affect their validity or enforceability, and you agree that we may communicate with you electronically for all aspects of your use of the Website. In particular, we wish to draw your attention to our policies relating to buying on the Website and our privacy policy in Section 17 below (“Privacy Policy”). If you are intending to sell on the Website, you will be required to enter into a further set of terms and conditions which contain our policy and terms in this regard. If you are under 16 you must let your parent or guardian know about our Privacy Policy before you use the Website or any of the Website's services. We reserve the right to only accept registration on the Website from those over 18.
 

Website

We seek to operate to international standards in distance-selling and e-commerce at all times. If you have a complaint about us just contact our customer Service Team giving full details of the issue and including date of purchase and order reference number where applicable and your full name and address and contact details. We will address any questions, queries or complaints not already answered in the Terms and Conditions as soon as we can.

Registration

1.1. To use some of the services or features made available to you on the Website you will need to register. As part of the registration process:

1.1.1. you will need to select a password which is in accordance with our password policy (accessible at the time of registration). 1.2. By registering, you are confirming that you are 18 years old or above, or if you are not, that you are accessing and using the Website with the permission of your legal guardian.

1.3. It is your responsibility to keep your account name and password safe as you are fully responsible for all activities that take place under your username and password. You agree to notify us immediately if you suspect any unauthorised use of your account or access to your password.

Using the Website

2.1. In order to buy items via the Website, you will be required to provide your personal details. In particular, you must provide your real name, phone number, email address, delivery address, and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.

2.2. The Website is available only to individuals and others who meet our terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to us, whose applications are acceptable to us and who have authorised us to process a charge or charges on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase. Items purchased by you as a buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, we reserve the right to require sellers to restrict multiple quantities of an item being shipped to any one customer or postal address.

2.3. By making an offer to purchase merchandise you expressly authorise us to perform credit checks and where we feel necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorise individual purchase transactions.

2.4. Furthermore, you agree that we may use personal information provided by you in order to conduct appropriate anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

2.5. We reserve the right to deny the use of the Website by any user, and/or the sale of any item on the Website (including removal of a listing), at any time, in our sole discretion and without having to give reason.

2.6. You agree that you will be personally responsible for your use of the Website and for all of your communication and activity on and pursuant to the Website. If we determine that you are or have been engaged in prohibited activities, were not respectful of other users, or otherwise violated the Terms and Conditions, we may deny you access to this Website on a temporary or permanent basis.

2.7. You may not do any of the following while accessing or using the Website: (a) access, tamper with, or use non-public areas of the Website, our computer systems, or the technical delivery systems of our providers; (b) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (c) access or search or attempt to access or search the Website by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by us (and only pursuant to the Terms and Conditions), unless you have been specifically allowed to do so in a separate agreement with us; (d) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Website to send altered, deceptive or false source-identifying information; or (e) interfere with, or disrupt (or attempt to do so), our transaction being conducted on the Web Site, or the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Website, or in such a manner as to interfere with or create an undue burden on the Website.

2.8. We reserve the right to establish any limitations on your usage of the Web Site as we may deem appropriate, in our sole discretion.

2.9. You must not offer or proceed to arrange any transaction in respect of any listing on the Website, other than on the Website and via our sales process, and you must not undertake any activity to seek to avoid payment to us of sales commission.

2.10. Your use of the Website must not contravene any applicable laws, rules, regulation, social norms, customs or commercial practices.
 

Orders

3.1. The Website is a venue to enable registered users to buy items. We allow sellers to make items available for sale through listings on the Website. We provide the ability for orders to be placed on the Web Site and we collect payment for items ordered as the agent of sellers (not for ourselves). All orders placed on the Website are subject to acceptance by sellers and availability. We are not able to confirm orders or availability.

3.2. Upon an order being placed by a user for an item, the contract is formed directly between the user (as buyer) and the seller. We do not process transfer of ownership of items on behalf of users, we pick, process, pack, dispatch and ship orders but we do not warehouse or store any item listed on the Website for sale.

3.3. When clicking on the “Proceed to Checkout” link, you, as buyer, are entering into an agreement with a seller to purchase the item(s) contained in your basket. You must complete the transaction in the manner specified. By agreeing to purchase an item via the Website, you are impliedly stating that you have the legal right to enter into and complete the transaction.

3.4. Once an order is placed, a refund or exchange may not be offered, including if you change your mind at any time before delivery. Please ensure that you have read and understood all of our terms of purchase before placing an order on the Website.

3.5. We cannot guarantee that your monitor’s display of any colour of any item listed on the Website will be completely accurate, and some items, because of their nature, may vary slightly from the images shown in the listing of the item on the Website.


3.6. When a successful purchase has been made, you (as buyer) are responsible for:

3.6.1. communicating with us as appropriate in order to complete the transaction;

3.6.2. providing the correct and complete shipping address for the item;

3.6.3. complying with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase the item via the Website;

3.6.4. all import duties and tax for the delivery of the item.

3.7. We will store a record of your transactions on the Website for a minimum of one year.

Pricing

4.1. Product prices are set by sellers at the time an item is listed for sale on the Website using existing currency exchange rates. These prices are subject to change if an applicable currency exchange rate changes before your order is accepted or the items are subject to markdowns at any time during the selling process up to confirmation of payment.

4.2. We also reserve the right to change the prices of any items or services made available on the Website before your order is accepted or at any time during the selling process up to confirmation of payment.

4.3. If you are a customer whose credit/debit card is not denominated in KWD, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. We are not liable for any exchange fees in respect of any purchases made through the Website and you shall be responsible for any and all liabilities in relation to the same.

Payment

5.1. We accept Visa, MasterCard and KNET cards, and any other methods which may be clearly advertised on the Website from time to time. Payment will be debited and cleared from your account before dispatch of your order. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.

5.2. We take reasonable care to make the Website secure. All credit/debit card transactions on this site are processed using a secure online payment gateway that encrypts your card details in a secure host environment. We will securely store your credit/debit card details on our systems. These details will be fully encrypted and only used to process card transactions which you have initiated.

5.3. Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Repeated Returns

We monitor the number of returns made by customers and may refuse to accept orders at our discretion if goods are returned repeatedly.

Intellectual Property

9.1. We reserve all our intellectual property rights with respect to any graphics, photographs (including (without limitation) all image rights), sounds, music, video, audio or text on the Website, excluding Your Content (as defined below) ("Our Content”).

9.2. Your use of the Website and any related services grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to Our Content, including our Software and all HTML and other code contained in the Website. All Our Content, including third party trademarks, designs, and related intellectual property rights mentioned or displayed on the Website are protected by national intellectual property and other laws and international treaty provisions. 16.1. Personal information do we collect from you and how:

How you can access and if necessary, change the personal information we maintain If for any reason you are concerned that the personal information held by us is not correct, please visit the Website and, after logging into the Website using the "Sign In" menu on the homepage, your personal information will be made available for review and change in the "Profile" section. Only you or, upon your request, our customer care department, may access your personal data from the Website. Information may be changed online within “My Details”, “Shipping Details”, and “My Email Preferences”. You can change or delete saved credit/debit card details each time you make a purchase. You will also be able to delete saved credit/debit card details by adding or editing a shipping/billing address. If you change your billing or shipping address while your order is still being processed, the order will be re-processed through security validation checks. If you breach these Terms & Conditions and we take no immediate action, this does not mean that we will not be entitled to assert our rights and remedies at a later date.

Dispute Resolution

In the event of any dispute between you and us, we will first attempt to resolve the dispute amicably and in good faith. If that is not possible, either we or you may refer the dispute to be finally settled by binding arbitration by one (1) arbitrator in accordance with the rules of the Kuwaiti law the arbitration shall be conducted in the Arabic language and the arbitration award shall be final and binding on you and us.

We are committed to providing each of our users with clear information regarding their purchase. We will make every effort to contact you if you have agreed to purchase a product and it is not available at the stated price. We will NOT charge you if you do not acknowledge that you agree to continue with the purchase at any revised price, if such revised price exceeds the price displayed on the Website at the time you agreed to make the purchase.

We cannot guarantee that every item featured on the Website is in stock and available for delivery. We will contact you if you have ordered any item that is out of stock and you will NOT be charged for this item.

We make every effort to provide clear and accurate details of all items featured for sale on the Website, based on our Partners’ descriptions of their items we feature on the Website. Where an item is available in various colours, patterns or designs, we cannot guarantee that your preferred colour will be delivered to you, unless the item colour/pattern/design is stated in the item’s title.

Following your placing an order on the Website by pressing the “confirm” button at the end of the checkout process, we will send you an acknowledgement email detailing the items that you have ordered. This is not an acceptance of the sale of the relevant item(s) to you. If you have already paid for such item(s), we will provide you with a full refund in respect of any item we have not agreed to sell to you, as soon as reasonably possible. You must notify us if they wish to cancel any order or part order before any item(s) comprising such order are dispatched.

We reserve the right to refuse the sale to you of any item featured on the Website at our sole discretion and at any time prior to shipping. Our non-acceptance of such sale agreement will usually take place for one or more of the following reasons:

7.1. the item(s) you ordered are out of stock. We will inform you of this by email or phone call. You will not be charged for any items that are out of stock.

7.2. we were unable to authorise your payment. We will inform you of this by email. Your order will be canceled and you must place your order again if you wish to purchase the relevant item(s);

7.3. we identify that an item you ordered was priced incorrectly in its listing on the Website, or its description was inaccurate. We will email you to inform you of this with revised details of the item, and ask you whether you wish to proceed with the order;

7.4. you have breached the Terms & Conditions. We will inform you of this, your order will be cancelled and you will not be charged for it.

Delivery/Collection

We are not liable for any delays to any stated delivery times and we cannot guarantee that your order will be delivered or available for collection by you (applicable) at the delivery time assigned to it.

Please check the list of countries that we deliver to as set out in our Delivery Policy before placing any order. We can only process orders for delivery or collection within countries in which the relevant items are permitted to be sold.

If you have opted for collection at one of our click and collect lounges/centres, you must collect the order within 7 days of notification that the order is ready for collection, failing which we reserve the right to cancel the order, re-list the relevant item(s) for sale on the Web Site, and refund your payment.

If it is not possible to deliver your order at the designated delivery address, delivery will, where possible, be attempted again at a different time of day. If delivery is still not able to be effected, our Customer Care Department will contact you to arrange re-delivery on another day. Additional shipping charges may apply. An order will only be left with a third party (such as building caretaker or a maid) with your express authority.

We will try our best to ensure that orders are delivered to the designated delivery address by the estimated delivery/collection date set out in our order confirmation email. Occasionally, the supply of item(s) comprised in your order may be delayed or prevented for reasons beyond our control (e.g. material shortages, import delays or higher than anticipated demand). Where this is the case, we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

If it is not possible to meet an estimated delivery/collection date, we will contact you as soon as we can with a revised estimated date.

Title/ownership of the items you purchase via the Website will pass to you on delivery and therefore you assume all risk in them from that point, and we will not be liable for their loss or destruction.

We accept no responsibility if your payment card details or your Website username and password are used by another person whether knowingly by you or otherwise. You are responsible for all activities that occur under your Website username and password.

Please take care when trying on your purchases and return any items in the same condition as supplied. Any returns that do not meet our returns policy will not be accepted.

• in respect of credit card payment: the refund be by way of credit applied to the relevant credit card account. The refund should appear in your next credit card statement.
